What is this?

The Terms of Service (TOS) are the rules and regulations that specify guidelines for using our services. The use of our services is subject to these terms. Please read them carefully and ensure that you understand and agree to all parts. The use of SowfiHost’s services implies agreement with these terms!

Terms of Service

SowfiHost (hereinafter referred to as “SowfiHost”) provides web hosting services to people all around the world. We have the responsibility to protect each client and provide them with the best service possible. The following guidelines were designed to ensure that our services remain of the utmost quality. Please read very carefully before ordering and/or using SowfiHost's services.

Resource Usage Policy

The SowfiHost Resource Usage Policy is an extension of the Terms of Service containing more specific utilization policies. Please make sure you agree with its points and conditions before signing up for or using SowfiHost’s services. Contact our sales department for any clarification.

Content

All services provided by SowfiHost may be used for lawful purposes only. Transmission, storage, or presentation of any information, data, or material in violation of any law is prohibited. This includes, but is not limited to copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and another statute. The subscriber agrees to indemnify and hold harmless SowfiHost from any claims resulting from the use of the service which damages the subscriber or any other party.

Note: Pornography and sex-related merchandising are prohibited on any SowfiHost server. This includes sites that may infer sexual content or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to SowfiHost servers or any other server on the Internet. Links to such materials are also prohibited. Contact our sales department for any clarification.

Examples of non-acceptable content

a.) Movie Related Sites, Uploading or Downloading Sites or File Hosting Sites.
b.) Pirated software, Social Connections Related Scripts or Applications.
c.) Bulk Email related products.
d.) Pornography.
e.) Hacking/cracking related websites.
f.) Warez and/or copyrighted MP3s.
g.) Material illegal under Indian & United States of America law h.) Sites containing or linking to material that may be considered detrimental to public health, safety, or welfare. (Such as but not limited to Anarchists Cookbook, bomb-making, weapon information, or anything else that may be considered detrimental or illegal.) SowfiHost will be the sole arbiter as to what constitutes a violation of this provision and reserves the right to deactivate and remove any site at any time for any reason.
i.) CPU/Resource intensive Programs.
j.) Denial of Service Attacks.
k.) Hacking/cracking of any kind (This includes exploits).
l.) Account trading.
m.) Spamming.
n.) Transmission, storage or distribution of any information, data, or material in violation of any law or regulation is prohibited. This included but not limited to copyrighted material, trademarks, or any other illegal content. Examples: Movies, MP3s, Pirated Software, Hacker Programs, or Warez Sites.
o.) Nulled, Craked, GPL (General Public License) and downloaded from unofficial/third-party websites.
p.) Warez, image/file dump, mirror, or ad services.
q.) Sale of a controlled substance or online pharmacies.
r.) Autosurf sites, investment sites, escrow, HYIP, bank debenture programs, or lottery sites.
s.) Brute force programs, IP scanners, mail bombers, and spam scripts.
t.) We do not allow IRC on our VPS and Shared servers. We allow game servers on our VPS accounts however they must follow our server resource policy.

Storage Usage

1) You can't host video or music sites.
2) You can't use our web hosting for storage.
3) You can't use our web hosting to back up your files.
4) You can't upload multiple large files.

Copyright Violations

SowfiHost will respond to all reports of infringement that are formatted in accordance with the Digital Millennium Copyright Act and any other applicable copyright laws. Notices of infringement that do not comply with this act will not be processed. We will act in accordance with the DMCA when handling infringement reports

System Resource Usage

If SowfiHost’s system administration team determines that an account is utilizing an unacceptable amount of system resources, SowfiHost may temporarily deactivate the account in question. If SowfiHost’s staff deems it necessary, an eviction notice may be sent to the customer of an offending account providing them with seven (7) days in which to either upgrade to a VPS or other hosting solution as recommended by SowfiHost staff or locate a new provider. This only occurs in extreme cases; SowfiHost will do all it can to assist customers prior to this scenario. SowfiHost will be the sole arbiter as to what constitutes a violation of this provision. Because of the nature of this provision, each account will be considered and analyzed individually.

Backups

SowfiHost performs nightly backups of Web Hosting, Reseller Hosting and WordPress hosting servers; however, these backups are for SowfiHost’s administrative purposes only, and are in NO WAY GUARANTEED! Customers are responsible for maintaining their own backups on their own personal computers. SowfiHost does not provide any sort of compensation for lost or incomplete data in the event that backups do not function properly (even if the malfunction was due to negligence on SowfiHost’s part). We will do our best to ensure complete and accurate backups, but assume no responsibility for this duty. Always back your site up to your personal computer! We make no guarantees about the availability of backups.

Unsolicited Email (SPAM)

SPAMing, or the sending of unsolicited email, from a SowfiHost server or using a return email address that is maintained on a SowfiHost server, is STRICTLY prohibited. Using SPAM to advertise a site hosted on SowfiHost’s network also constitutes a violation of this provision. SowfiHost will be the sole arbiter as to what constitutes a violation of this provision. Sites found to be in violation of our SPAM policies will be immediately deactivated.

For anyone intentionally spamming on our systems, we reserve the right to bill them at a rate of $90/hour for any cleanup, research, and related work from their illegal activities. Help us STOP SPAM! Please email our abuse department immediately to report a violation of our SPAM policies.

Support Abuse

At SowfiHost, we always treat our customers with the utmost respect. In return, we expect the same from you. If our staff feels that you are consistently addressing them in a demeaning or rude manner, your account may be suspended and you may be asked to take your business elsewhere. In the event that we terminate service for support abuse, customers will be given ten (10) day's notice to find a new host.

Server Abuse

Any attempts to undermine or cause harm to a SowfiHost server or customer of SowfiHost are strictly prohibited. SowfiHost will be the sole arbiter as to what constitutes a violation of this provision. Accounts found in violation of this provision will be subject to immediate account deactivation. SowfiHost will turn all available information about abuse incidents, including customer contact data, over to the proper authorities and press charges.

Cancellation

Cancellations are processed by our Billing department. To cancel an account, a cancellation request via Client Portal ( sowfihost.com/clientarea ) must be submitted. The following information is required when submitting a cancellation request in Client Portal ( sowfihost.com/clientarea ): a.) The primary domain name on account b.) Confirmation that you have downloaded a backup of all necessary files The above information is required for the protection of all customers to ensure only account owners are able to cancel accounts.

Price Change

SowfiHost reserves the right to change prices or any other charges at any time. We will provide you with at least thirty (30) days’ notice before charging you with any price change on any annual or longer-term plans. It is your sole responsibility to periodically review pricing on our website and billing information provided by SowfiHost through the client area or through other methods of communication, including notices sent or posted by SowfiHost.

Late Payments

Any account not paid in full by the end of the Term will be given a seven (7) day grace period. If payment is not made within the seven (7) day grace period, SowfiHost reserves the right to suspend your Services. SowfiHost reserves the right to terminate Services fifteen (15) days after the payment due date.

SowfiHost is not responsible for any damages or losses (including any data) as a result of suspension or termination for non-payment of your account. In addition, SowfiHost reserves the right to refuse to reactivate your Services until any and all outstanding invoices have been paid in full.

Free Domain Name Registration Policies

We are happy to provide a free domain name on our Ultimate plan.
The free domain name must be ordered with the hosting package during signup and this offer cannot be customized. (The domain name will be free only for the first year and renewal charges will be applicable from the second year).

Money-Back Guarantee and Refund Policies

The 30-Day Money Back Guarantee applies to the following services only:
Web Hosting
WordPress Hosting
Note that the 30-day period ends exactly 30 days from the day on which the account was originally activated (not the day the order was placed). It is not valid for account renewals. The Money-Back Guarantee is VOID if your account violates our Terms of Service, Service Agreement, or any of our policies in place. Setup fees are non-refundable. External services, such as but not limited to, installation charges, etc., are non-refundable. Outside of the Money Back Guarantee, SowfiHost has a no refund policy.
SowfiHost account credits issued to accounts are not eligible for a refund and will remain on the account for two (2) years after the last hosting account is cancelled. If the service credit is not utilized within that time frame, said service credit is forfeited and You hereby agree to release SowfiHost from all liability for use of such service credits.

Free Migration Policies

At SowfiHost, we offer free website migration services for all customers who have an existing website with another hosting provider and want to switch to us.

Free Migration Service important notes:
The website migration service does not include transferring a domain name.
You can request a free migration within 30 days from the moment your order is activated. We can migrate up to 1 cPanel account (website files, MySQL databases, and email data) — free of charge.
Should you require additional migrations above what is included with our free migration service or after 30 days, additional charges are applicable.
Base pricing is outlined below, however, discounts may be offered for bulk migrations: $10 per cPanel Account (cPanel Migrations)

Failure to Follow Policies

Failure to fully comply with these terms is grounds for account suspension and/or deactivation. Any accounts and/or servers contained within SowfiHost’s network must adhere to the above policies.
We reserve the right to remove any account without prior notice. Our normal policy is a warning first, and account deactivation the second offence, but no warning is required.
SowfiHost reserves the right to deactivate and remove any site hosted on our servers that contains any content that it deems in its sole discretion to be unacceptable, undesirable or contraindicated.
